Respecting the privacy of the users of the APP is of utmost importance for us. Therefore, we wish to inform you that the data collected in our databases are used solely for the purpose of provision of services.
Accepting this document is an essential condition for using the APP. Lack of consent to any of the provisions included herein results in an obligation to stop using the APP and uninstall it.
LET’S GET TO KNOW EACH OTHER
The Administrator of your personal data collected in the mobile application YOUBID (“APP”) is YOUBID Sp. z o.o. with its registered office in Gliwice, Poland, or an entity indicated in the APP as a “YOUBID AGENT FOR THE COUNTRY” (“ADNIMINSTRATOR”).
Full register data of the ADMINISTRATOR: YOUBID Sp. z o.o. with its registered office in Gliwice, Poland, ul. Zwycięstwa 10, 44-100 Gliwice, entered into the commercial register of the National Court Register under KRS no. 0000746609. the register records are kept by the District Court in Gliwice, X Commercial Division of the National Court Register. In order to use the APP it is necessary to have a mobile device with installed iOS, Android or Windows Phone operating system, as well as a connection with the Internet (the user of the APP covers the costs of data transfer in accordance with the carrier’s fees). The APP may be downloaded from Google Play Store (Android), Apple App Store (iOS) or Microsoft Store (Windows Phone). The APP is free of charge; the services purchased through the APP are paid. A user of the APP may uninstall it at any time. The provisions set out herein constitute a supplementation of the respective regulations of Google Play Store, Apple App Store and Microsoft Store. YOUBID shall not be held responsible for the actions of these entities and their compliance with the provisions of the law.
Please note that in the scope of processing of personal data, we respect the provisions of the law prevailing for the location in which you use the APP. Moreover, in order to improve the level of personal data protection, we have decided to implement the most comprehensive legal regulation in this scope – GDPR (Regulation of the European Parliament and of the Council (EU) 2016/679 dated 27 April 2016 on the protection of natural persons in the scope of processing of personal data and on the flow of such data, repealing of the Directive 95/46/EC (General Data Protection Regulation)).
The APP may be used in two ways.
The first way of using the APP does not require the registration of a user account; the user has to submit their e-mail address, to which the purchased VOUCHER will be sent. During the purchase of a VOUCHER it will be necessary to submit the full name of a person authorised to use the VOUCHER.
A user may also decide to register a user account and immediately submit their personal data – name, surname and e-mail address. THE APP DOES NOT ALLOW FOR THE SUBMISSION OF ANY OTHER PERSONAL DATA, in particular residence and telephone number. Moreover, during the use of the APP we collect the following data associated with a user:
- name and surname of the user and their e-mail address;
- name and surname of the person authorised to use a VOUCHER;
- history of activities, in particular of previously purchased VOUCHERS.
The APP, upon being granted a consent from the user, may access the following data stored in the memory of the device on which it is installed:
- location data of the device on which the APP is installed.
In an event where during the purchase of a service a user submits personal data of a third person, such data shall be processed in accordance with the above process.
Moreover, during the use of the APP, it collects statistics from the user concerning its performance and errors. These information are anonymous, meaning that they are not related to a particular user and do not constitute personal data. The information are used for the development of the APP and for improving errors in its functioning.
We have received the data directly from you. The APP does not collect any of your personal data from other entities (including the publicly available registers) in order to associate them with your other information.
HOW WE USE YOUR DATA?
Your personal data are used solely with the purpose of provision of services purchased by you through the APP. Without your explicit content, we do not use your data for any other purposes, e.g. marketing. YOUR CONSENT FOR THE PROCESSING OF PERSONAL DATA FOR OTHER PURPOSES MAY BE REVOKED AT ANY TIME WITHOUT GIVING ANY REASON.
WHO DO WE TRANSFER YOUR DATA TO?
If, in a particular country, the provider of services is a third party independent from YOUBID, your personal data submitted in the APP are transferred to that party. Moreover, your personal data are transferred to other third party, but only upon your purchase of any service via the APP; in such case, we transfer your personal data (and potentially the data of a person to which the services are to be provided), i.e. name, surname and e-mail address, firstly to the payment service provider – ING BANK ŚLĄSKI with its registered office in Katowice, Poland, and secondly to a HOTEL that will directly provide the purchased services.
We conclude an agreement for the entrusting of personal data processing with every entity to which we transfer your data; such agreement specifies the terms governing the processing procedure, as well as suitable means of privacy protection.
WHAT IS THE BASIS FOR THE PROCESSING OF YOUR PERSONAL DATA?
The APP processes your personal data because it is necessary for the conclusion and proper execution of an agreement concluded during the creation of a user account (cf. YOUBID TERMS AND CONDITIONS), as well as of agreements for the provision of services (i.e. on the basis of Art. 6 item 1(b) of the GDPR); THE PROVISION OF SUCH DATA IS NECESSARY FOR THE EXECUTION OF THE AFOREMENTIONED ACTIVITIES – LACK THEREOF UNABLES THE USER TO USE THE APP AND PURCHASE SERVICES.
Moreover, we process your personal data for the purpose of execution of our justified interests – primarily for the defence from claims lodged by users against YOUBID and third parties, in particular hotels (i.e. on the basis of Art. 6 item 1(f) of the GDPR). Shall you express consent for the processing of your personal data for marketing purposes, the legal basis for all such actions shall be Art. 6 item 1(a) of the GDPR.
WHAT IS THE PERIOD OF PROCESSING OF YOUR PERSONAL DATA?
We process your personal data for the period equivalent to the functioning of you user account, as well as for the period of at least three years upon its deletion (regardless of the reason), unless the period of limitation for users’ claims against YOUBID or third parties, or for YOUBID’s or third parties’ claims against users, is longer.
WHAT ARE YOUR RIGHTS?
Remember that you are entitled to access your personal data, including the right to acquire a copy of your data, the right to correct your personal data, and the right to complete your personal data; in the cases foreseen by the GDPR, you have the right to remove your data, limit the processing of your data, transfer your data, disallow your data to be subject to automated decision making (including profiling), as well as the right to object against the processing of your personal data.
Some of the above rights may not be executed in all cases. You may request the correction or completion of your data only if your data are incorrect or incomplete. We are obliged to remove your data solely when your data are no longer necessary for the purposes for which they were collected or when you revoke your consent for the processing of your data; alternatively, we are obliged to do so when, in the scope indicated by the GDPR, an objection against the processing of data is raised.
Moreover, when the collected personal data are incorrect, you may request a limitation of the processing of such data for the period enabling us to check the correctness of the data, and if the processing of personal data takes place on the basis of a legally justified interest or for statistical purposes, and the objection is justified by the situation of the data subject, or when the data are processed for the purposes of direct marketing (in the scope specified by the GDPR), it is possible to raise an objection.
Every personal data subject shall be entitled to lodge a complaint to a supervisory authority competent for a certain country, and moreover, to the President of the Office for Personal Data Protection (supervising YOUBID) to the address: The President of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw, Poland.
AMENDMENTS
In case of introduction of any amendments to this document, its new version shall be available to the APP users with a suitable notification, and the new version shall be binding from the day of notification of an amendment. Any amendments shall be binding after 30 days from the moment of notifying the users. Every user of the APP shall be entitled to object against the amendments by uninstalling the APP or deleting their user account in the manner specified in the YOUBID TERMS AND CONDITIONS.
The issues covered herein are regulated solely by the provisions of the Polish Law and settled by Polish courts, unless the provisions of law prevailing for the location of use of the APP by a user state otherwise; IN PARTICULAR, USERS FROM THE EUROPEAN ECONOMIC AREA SHALL BE ENTITLED TO execute all rights granted through the prevailing provisions (in particular in the scope extending the consumer protection), as well as to institute legal proceedings in accordance with the suitable provisions. NONE OF THE PROVISIONS HEREOF SHALL LIMIT THE RIGHTS GRANTED TO THESE PERSONS.
